User Agreement

1. Definition of Terms

1.1. The terms used in this Agreement have the following meanings:

  • Site (Online Store) — a web resource located on the Internet at https://shop.alfainterplast.com.ua/, which hosts a catalog of products and the conditions for their purchase.
  • Seller (Site Administration / Manufacturer) — Alfainterplast Ltd., which manages the Site and sells the Products.
  • User (Buyer) — any legally competent individual or legal entity that uses the Site to view information or place an Order.
  • Product — goods, the offer for the purchase of which is posted on the Site.
  • Order — a properly executed request from the Buyer for the purchase and delivery of the Product selected on the Site to the specified address.
  • Agreement — this Terms of Use Agreement, which is a public contract (offer) defining the rules for using the Site and the terms of purchase and sale.

2. General Provisions

2.1. By using the site, you agree to the conditions of this Terms of Use Agreement. If you do not agree with any of the provisions of this Agreement, please stop using the site.

2.2. The Site Administration has the right to change the terms of this Agreement unilaterally without prior notice to users. The new version of the Agreement comes into force from the moment of its publication on the site.

3. Rights and Obligations

3.1. The User has the right to:

  • view information about the products;
  • place orders;
  • contact customer support;
  • use other services of the site in accordance with the legislation of Ukraine.

3.2. The User is obliged to:

  • provide accurate information when placing an order;
  • not perform actions that may disrupt the operation of the site (including not using automated parsing programs);
  • not use the site for illegal activities.

4. Product Information

4.1. The Manufacturer makes all reasonable efforts to ensure the accuracy of Product descriptions and specifications. Due to the policy of continuous product improvement, the Manufacturer reserves the right unilaterally, without prior notice to buyers, to make changes to the design, technical parameters, and configuration of the product, which do not deteriorate its operational properties.

4.2. Any visual materials (photos, 3D models, graphic images, etc.) are exclusively for informational and illustrative purposes and may differ slightly from the actual appearance of the serial product.

5. Order Placement

5.1. By placing an Order on the Site, the Buyer confirms the completeness and accuracy of the provided contact and personal data. The Buyer bears full responsibility for any consequences caused by the provision of inaccurate, incomplete, or erroneous information (in particular, the impossibility or delay in the delivery of the Product), and the Seller in such a case is exempt from liability for failure to fulfill obligations.

5.2. The placement of an Order by the Buyer is their offer to the Seller to conclude a purchase and sale agreement. After receiving the Order, the authorized representative of the Seller has the right to contact the Buyer (via phone or electronic communication) to confirm the relevance of the Order, clarify details, Product availability, and delivery terms. The purchase and sale agreement is considered concluded from the moment the Order is confirmed by the Seller.

5.3. The Seller reserves the right to unilaterally cancel the Order or refuse its execution in cases provided for by the current legislation of Ukraine, as well as in the event of:

  • absence of the ordered Product in stock (discontinuation of production);
  • discovery of a technical error in the display of the price or characteristics of the Product on the Site;
  • inability to contact the Buyer using the contact details provided by them within the period set by the Seller.

6. Intellectual Property

6.1. All intellectual property objects posted on the website https://shop.alfainterplast.com.ua/, including, but not limited to: text materials, product photos, graphic elements, logos, commercial names, design interface, and program code, are the exclusive property of Alfainterplast Ltd. or are used by it on legal grounds (with the consent of the authors or copyright holders).

6.2. No material from this website may be copied, reproduced, modified, distributed, or used in any form (including commercial use) without obtaining the prior written consent of the copyright holder. Unauthorized use of intellectual property objects is a violation of the Law of Ukraine "On Copyright and Related Rights" and entails civil, administrative, and/or criminal liability.

7. Liability of the Parties and Force Majeure

7.1. The Site Administration is not responsible for:

  • temporary unavailability of the site due to technical reasons;
  • actions of third parties, including payment systems;
  • delivery delays caused by carrier companies;
  • damages resulting from the improper use of purchased products.

7.2. The Parties are exempt from liability for failure to fulfill or improper fulfillment of their obligations in the event of force majeure circumstances, such as: natural disasters, military actions, lack of electricity or communication, Internet network failures, etc., which arose beyond the control of the Parties.

8. Personal Data

8.1. The purpose of processing personal data is to ensure the implementation of civil law relations, the provision of services, the settlement of payments, and the delivery of products in accordance with the legislation of Ukraine.

8.2. By providing their data during registration or order placement, the User gives their voluntary consent to the collection and processing of their personal data.

8.3. The Seller undertakes not to disclose the information received from the User. The transfer of information to third parties (postal services, courier companies, financial institutions) acting on the basis of an agreement with the Seller, exclusively within the limits necessary to fulfill the User's order, is not considered a violation.

9. Dispute Resolution

9.1. All disputes and disagreements arising between the Parties shall be resolved through negotiations. If an agreement is not reached, the dispute is subject to consideration in court in accordance with the current legislation of Ukraine.
